Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the TinyFolder application and the tinyfolder.app website (together, the "Service"), provided by Sergei Filkov, a sole proprietor established in the country of Georgia ("TinyFolder", "we", "us", or "our").

By downloading, installing, or using TinyFolder, or by purchasing a license, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TinyFolder is a macOS application that lets you create customizable app folders and pin them to your Dock. A free tier is available with limited functionality. A paid "Lifetime" license unlocks all Pro features.

2. License

Subject to these Terms and payment of any applicable fees, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use TinyFolder on Mac computers that you own or control, for your personal or internal business use.

A Lifetime license is a one-time purchase tied to you and activated with your email address and a license key. You may activate it on the Mac computers you personally use. You agree not to share, resell, sublicense, or distribute your license key.

3. Restrictions

You agree not to: (a) copy, modify, or create derivative works of the Service except as permitted by law; (b) reverse engineer, decompile, or attempt to bypass the licensing, activation, or payment systems; (c) resell, rent, or redistribute the Service or license keys; or (d) use the Service unlawfully or to infringe the rights of others.

4. Purchases, Pricing, and Payment

Payments are processed by our reseller and Merchant of Record, Paddle (Paddle.com Market Ltd and its affiliates). When you buy a license, your transaction is with Paddle, and Paddle's Buyer Terms apply in addition to these Terms. Paddle handles billing, payment, and applicable taxes, and is responsible for tax collection and remittance.

Prices are shown on tinyfolder.app and may change at any time; changes do not affect purchases already completed.

5. Refunds

We offer a 14-day money-back guarantee: if you're not satisfied, you can request a full refund within 14 days of purchase, for any reason. Refunds are handled in accordance with our Refund Policy and Paddle's refund terms.

6. Updates

We may release updates and may add, change, or remove features over time. Some features may depend on your operating system version. A Lifetime license includes the version you purchased and future updates we make available for it; we do not guarantee perpetual updates.

7. Intellectual Property

The Service, including all software, design, text, and trademarks, is owned by Sergei Filkov or its licensors and is protected by applicable laws. These Terms grant you no rights other than the license described above.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which explains what we collect and why.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, TinyFolder (Sergei Filkov) will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid for it in the 12 months before the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory consumer rights.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will survive.

12. Governing Law

These Terms are governed by the laws of the country of Georgia, without regard to its conflict-of-laws rules. The courts of Georgia will have jurisdiction, except where mandatory consumer-protection laws of your country of residence grant you additional rights or require a different forum.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above will reflect any changes. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
